ECO PEST CONTROL – TERMS OF SERVICE

These Terms of Service (“Terms”) govern any inspection, estimate, treatment, service, plan, renewal, invoice, or related work performed by Eco Pest Control (“Eco Pest Control,” “we,” “us,” or “our”) for any customer (“Customer,” “you,” or “your”). By booking, approving, signing, paying for, or receiving services from Eco Pest Control, you agree to these Terms.
If these Terms conflict with a signed agreement or Work Order, the signed agreement/Work Order controls.
1) Definitions
- Services: Any pest control, termite services, inspections, treatments, follow-ups, prevention plans, baiting, spot treatments, or related work.
- Work Order / Contract: Any signed agreement, proposal, inspection report, invoice approval, or authorization.
- Property: The service location listed on the agreement or invoice.
- Service Plan: Any recurring monthly, bi-monthly, quarterly, annual, or renewal service plan.
2) Scope of Work
Eco Pest Control will provide services as described in your Work Order, Contract, estimate, or invoice.
Any work not explicitly included in the scope is excluded and may require an additional charge.
3) Estimates & Pricing
Prices may be provided verbally, in writing, by text, by email, or through invoice/portal. Estimates are based on information available at the time.
If conditions differ from what was disclosed or observed, Eco Pest Control may revise pricing or scope before proceeding.
4) Authorization to Perform Services
You authorize Eco Pest Control to perform the Services at the Property if you:
- sign a contract/work order, or
- approve by text, email, phone call, online portal approval, or
- schedule/accept service and allow our technician access.
5) Customer Responsibilities (Access, Preparation, Safety)
You agree to:
- Provide safe access to the Property and service areas.
- Remove or secure pets as instructed.
- Follow preparation instructions (including termite prep or pest prep).
- Inform Eco Pest Control of hazards, including: aggressive animals, unsafe crawlspaces, structural instability, mold exposure, electrical hazards, contaminated areas, or weapons on site.
Eco Pest Control may refuse or stop service if conditions are unsafe or access is not provided. In such cases, service fees may still apply.
6) Right to Refuse or Stop Service
Eco Pest Control may refuse or suspend service if:
- unsafe conditions exist,
- Customer behavior is abusive or threatening,
- Customer fails to provide access,
- payment issues exist (including unpaid invoices),
- required prep is not completed.
7) Scheduling, Arrival Windows & Delays
Appointments are scheduled by date and approximate arrival window. Arrival windows are estimates, not guarantees.
Delays may occur due to traffic, prior jobs, weather, emergency calls, or operational needs.
8) Cancellations, Rescheduling, and Missed Appointments
Customers must provide notice to reschedule or cancel.
If we arrive and cannot perform service due to lack of access/prep or Customer absence, Eco Pest Control may charge a trip fee or missed appointment fee as permitted by law.
9) Payment Terms
Unless otherwise stated in writing:
- Payment is due upon completion of service.
- For recurring service plans, billing may occur automatically per plan schedule.
Acceptable payment methods include cash, card, bank transfer, electronic invoice payments, or portal payments.
10) Late Fees, Delinquent Accounts & Default
If payment is not received when due, the account becomes delinquent.
Eco Pest Control may send reminders via SMS, email, phone call, or mail regarding unpaid balances.
30 Days Past Due (Past Due Notice): If payment is not received within thirty (30) days of the invoice due date, Eco Pest Control may suspend service scheduling and/or cancel future scheduled services until the balance is paid in full.
60 Days Past Due (Late Fee): If payment is not received within sixty (60) days of the invoice due date, Eco Pest Control may assess a one-time late fee equal to twenty percent (20%) of the unpaid balance, to the maximum extent permitted by applicable law.
90 Days Past Due (Default / Collections): If payment is not received within ninety (90) days of the invoice due date, the account may be considered in default. Eco Pest Control may:
- suspend or terminate service plans or guarantees,
- refuse to perform future services until paid in full,
- refer the account to collections,
- pursue lawful remedies where economically reasonable.
Late fees are intended to reflect administrative burden and financial risk and are charged to the maximum extent permitted by applicable law. If any portion is deemed unenforceable, the remaining portions remain enforceable.
11) No Guarantee Without Payment
If full payment is not received:
- any guarantees, warranties, and renewal benefits may be suspended or voided,
- Eco Pest Control may decline follow-up service until balance is paid.
12) Chargebacks & Payment Disputes
If you have a billing concern, you agree to contact Eco Pest Control before initiating any chargeback or dispute.
If a chargeback/dispute is filed for properly scheduled, performed, or completed Services, Eco Pest Control may submit documentation including:
- signed agreements/work orders,
- technician notes,
- photographs,
- communications,
- invoices,
- service logs.
Chargebacks do not cancel payment obligations. If payment is reversed, you remain responsible for:
- the outstanding balance,
- chargeback fees,
- administrative costs,
- collection costs (if applicable),
to the extent permitted by law.
13) Recurring Service Plans & Renewals
If you enroll in a recurring plan, you authorize recurring billing according to the agreed frequency unless cancellation is submitted in writing or through the portal per cancellation policy.
Plan terms, pricing, renewal fees, and frequency may change with notice. Continued service constitutes acceptance.
14) Termite & Pest Guarantee Terms
Guarantees (if applicable) are limited, service-based guarantees and are governed by:
- the signed termite agreement/work order,
- applicable renewal terms,
- compliance with preparation and access requirements.
Eco Pest Control does not guarantee that pests will never appear. Pest control reduces and manages pest activity; results vary based on environment, sanitation, weather, neighboring infestations, structural conditions, and Customer cooperation.
15) Exclusions & Limitations of Service
Unless specifically listed in writing, Services do not include:
- structural repairs,
- drywall/wood replacement,
- mold treatment,
- deep cleaning or sanitation,
- exclusion/rodent proofing,
- wildlife removal,
- damage repair,
- treatments requiring additional permits or special conditions.
16) Limitation of Liability
To the maximum extent permitted by law:
Eco Pest Control is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
Eco Pest Control’s total liability for any claim related to Services will not exceed the amount paid for the specific service giving rise to the claim.
17) Property Damage Disclaimer
Eco Pest Control is not responsible for:
- pre-existing damage,
- hidden conditions,
- structural issues,
- damages caused by pests, termites, rodents, or wildlife.
Customer acknowledges that pests/termites may have already caused damage prior to treatment.
18) Indemnification
Customer agrees to indemnify and hold harmless Eco Pest Control from claims, damages, losses, and expenses arising from:
- Customer’s failure to prepare the Property,
- unsafe site conditions not disclosed,
- Customer negligence or misrepresentation,
- third-party actions at the Property.
19) Photos, Documentation & Records
Eco Pest Control may take photos/video of service areas for documentation, compliance, training, and dispute resolution. These records do not include intentional photography of personal/private items unrelated to service.
20) Communications Consent (Calls, Texts, Emails)
You consent to receive service-related communications including:
- appointment reminders,
- invoices,
- late payment reminders,
- portal links,
- service updates,
via call, SMS, email, or automated systems.
You may opt out of marketing messages, but service-related operational messages may still be sent.
21) Customer Portal
Eco Pest Control may provide portal access for:
- invoices,
- balances,
- payment history,
- statements,
- agreements,
- service history.
Portal access is a convenience tool. Eco Pest Control is not responsible for outages or third-party portal failures.
22) Privacy
Customer data is used for service, billing, compliance, and internal operations. Eco Pest Control does not sell sensitive personal information.
23) Governing Law / Venue
These Terms are governed by the laws of the State of Florida.
Any legal action arising from these Terms or Services shall be brought in Miami-Dade County, Florida unless otherwise required by law.
24) Dispute Resolution & Attorney’s Fees
If a dispute arises, Customer agrees to attempt good-faith resolution by contacting Eco Pest Control before legal action.
If Eco Pest Control must pursue collection or enforcement, Customer agrees to pay reasonable costs and attorney’s fees as permitted by law.
25) Severability
If any clause is found unenforceable, the remainder remains enforceable.
26) Entire Agreement
These Terms, together with any signed agreement/work order/invoice approval, constitute the full agreement between Customer and Eco Pest Control.
27) Updates to Terms
Eco Pest Control may update these Terms. Updated Terms apply to future services and ongoing plans after posting or notice.
28) Language
These Terms may be provided in English and Spanish for convenience. In the event of inconsistency, the English version controls.
